Terms of Service

These Terms of Service (“Terms”) govern access to and use of FieldHaus's AI receptionist platform, including our website, phone/voice AI, web chat widget, and related dashboard (collectively, the “Service”), provided by FieldHaus (“FieldHaus,” “we,” “us,” or “our”). By creating an account or using the Service, you (“Customer,” “you”) agree to these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business.
1. The Service
FieldHaus provides an AI-powered virtual receptionist that answers phone calls and web chat messages on behalf of a Customer's business, answers questions using information the Customer provides (“Business Brain”), and books appointments on the Customer's connected calendar. FieldHaus is a tool that assists your business — it does not replace your judgment, and you remain responsible for your business's services, pricing, scheduling decisions, and interactions with your own customers.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
3. AI limitations — please read carefully
FieldHaus uses artificial intelligence (including third-party AI models) to generate responses to callers and chat visitors. AI-generated responses:
- May occasionally be inaccurate, incomplete, or fail to reflect your business's current pricing, availability, or policies, particularly if your Business Brain information is outdated or incomplete.
- Should not be relied upon as professional, medical, legal, or safety advice given to your customers.
- May not always correctly detect true emergencies — the Service is not a substitute for 911 or other emergency services, and FieldHaus is not liable for the AI's handling of any emergency or urgent situation.
You are responsible for reviewing and keeping your Business Brain content accurate, and for monitoring conversations and appointments through your dashboard. You should not treat the AI as infallible and should establish your own process for reviewing flagged or escalated conversations promptly.
4. Call recording
By using FieldHaus's voice feature, you authorize FieldHaus to record and transcribe calls made to your connected business phone number, as described in our Privacy Policy. You are responsible for ensuring your use of call recording complies with laws applicable to your business and your callers' locations, including providing any additional notice required in your jurisdiction. FieldHaus can configure a spoken recording disclosure in your AI greeting on request.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Send unsolicited, fraudulent, deceptive, or harassing communications.
- Impersonate any person or misrepresent your business.
- Interfere with or disrupt the Service, or attempt to access it through unauthorized means.
- Collect sensitive personal information (e.g., health, financial account, or government ID numbers) from callers beyond what is reasonably necessary to provide your services.
We may suspend or terminate accounts that violate this section.
6. Fees and billing
Fees for the Service, if any, are as described on our pricing page or in a separate order form/agreement. Beta or trial customers may be offered free or discounted access for a defined period, as communicated at signup; standard pricing applies afterward unless otherwise agreed in writing. Fees are non-refundable except as required by law or as we otherwise agree.
7. Third-party services
The Service relies on third-party providers (including telephony, AI, calendar, and hosting providers). We are not responsible for outages, errors, or changes in these third-party services that are outside our reasonable control, though we will work to restore functionality promptly.
8. Intellectual property
FieldHaus retains all rights in the Service, its software, and its underlying technology. You retain all rights in your own business content (Business Brain information, branding, customer data). You grant FieldHaus a limited license to use your business content solely to provide the Service to you.
9. Confidentiality and data
Our collection and use of personal information is governed by our Privacy Policy, incorporated into these Terms by reference. As between you and FieldHaus, you remain the data controller for information about your own customers collected through the Service, and FieldHaus acts as your service provider/processor for that data, as described in the Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED RESPONSES WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDHAUS AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO FIELDHAUS IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold FieldHaus harmless from claims, damages, and expenses (including reasonable legal fees) arising from your business's services, your violation of these Terms, or your violation of applicable law in connection with your use of the Service.
13. Term and termination
These Terms remain in effect while you use the Service. Either party may terminate at any time, subject to any minimum term stated in a separate order form. We may suspend or terminate your account immediately if you violate these Terms, misuse the Service, or fail to pay applicable fees. On termination, your right to use the Service ends, though certain provisions (including Sections 8–12) survive termination.
14. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. We will post updated Terms here with a new “Last updated” date and, for material changes, provide additional notice (such as by email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Saskatchewan, unless otherwise required by applicable law.
